Welcome to VisaSync! These Terms and Conditions ("Terms") govern your access to and use of the VisaSync platform, which is a SaaS solution designed to manage international candidate visa and permit applications. By using VisaSync, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Definitions

• "VisaSync," "We," "Our," or "Us" refers to the VisaSync SaaS platform and its associated services].

• "User," "You," or "Your" refers to the individual or entity that uses VisaSync services.

• "Services" refer to the VisaSync platform, which includes job opportunity matching, visa tracking, document management, compliance features, and other related services provided to international candidates, immigration consultants, recruitment agencies, HR departments, and other users.

2. Acceptance of Terms

By accessing or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any future modifications. We reserve the right to update or change these Terms at any time. Your continued use of the service after such changes constitutes your acceptance of the new Terms.

3. Use of Services

3.1 Eligibility

To use VisaSync, you must have the legal capacity to enter into binding agreements. You are responsible for ensuring that your use of the platform complies with applicable laws and regulations.

3.2 License

We grant you a non-exclusive, non-transferable, revocable license to use the VisaSync platform in accordance with these Terms. You may not resell, sublicense, or otherwise distribute the services without prior written permission from VisaSync.

3.3 Account Registration

You must register for an account to use certain features of VisaSync. When registering, you agree to provide accurate and complete information and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.

4. Subscription and Payment Terms

4.1 Subscription Plans

VisaSync offers various subscription plans, which may include free trials, monthly, or annual plans. By subscribing to a plan, you agree to pay all applicable fees in connection with the subscription.

4.2 Billing and Payments

All fees are due in advance and are non-refundable, except as stated otherwise in our refund policy. You authorize VisaSync to charge the payment method associated with your account for all subscription fees. We may suspend or terminate your access to the platform if your payment fails.

4.3 Changes to Subscription Plans

VisaSync reserves the right to change the fees and features associated with our subscription plans. Any changes will be communicated to you in advance, and the new rates will apply to your next billing cycle unless you cancel your subscription.

4.4 No Refund Policy for Services

Once a service has been purchased on the VisaSync platform, payment is final and non-refundable. VisaSync acts solely as an intermediary between you (the worker) and the employer, consultant, or service provider. Therefore, a refusal of your work permit or visa, as well as a rejection of your job application, is not the responsibility of VisaSync and is not grounds for a refund. We are not liable for the outcomes of your visa, job, or immigration applications.

5. User Responsibilities

5.1 Acceptable Use

You agree to use VisaSync solely for lawful purposes and in a manner consistent with these Terms and all applicable laws. You may not:

• Use the platform to post or transmit any unlawful, harmful, or objectionable content.

• Interfere with or disrupt the integrity or performance of the services.

• Attempt to gain unauthorized access to the platform or its related systems.

5.2 Content Ownership

You retain ownership of all the content and data you upload to VisaSync, including but not limited to candidate information, job applications, and documents. By using our services, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing the services.

6. Data Privacy and Security

6.1 Data Protection

VisaSync takes data protection and privacy seriously. By using the platform, you consent to our collection, use, and disclosure of your personal information as outlined in our Privacy Policy. We use industry-standard measures to protect the confidentiality, integrity, and availability of your data.

6.2 User Responsibilities for Security

You are responsible for maintaining the security of your account credentials and all activity occurring under your account. If you become aware of any unauthorized access to your account, you must notify us immediately.

7. Intellectual Property

All intellectual property rights in and to the VisaSync platform and services, including software, design, trademarks, and content, are owned by VisaSync or its licensors. You may not reproduce, distribute, or create derivative works from any content provided by VisaSync without express written consent.

8. Disclaimer on Visa and Permit Processing

VisaSync is a platform designed to facilitate connections between candidates, employers, and immigration professionals. VisaSync itself does not provide immigration, visa, or work permit processing services. All visa and permit applications are handled by independent immigration consultants or lawyers hired by either the candidate or the employer.

VisaSync cannot guarantee the success of any visa or permit application, nor can we be held responsible for any outcomes related to the visa or permit process. The role of VisaSync is to provide a platform that allows candidates, employers, and immigration professionals to collaborate and manage the application process efficiently.

Users are responsible for ensuring that their immigration consultants or legal representatives are duly licensed and qualified to provide visa and immigration services. VisaSync shall not be liable for any advice, services, or errors made by third-party immigration professionals, nor for any delays or rejections in the visa or permit approval process.

9. Limitation of Liability

To the fullest extent permitted by applicable law, VisaSync and its affiliates, officers, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, even if advised of the possibility of such damages. Our liability for any claim arising out of or related to these Terms or your use of the platform shall not exceed the amount paid by you for the services in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless VisaSync, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the platform or breach of these Terms.

11. Governing Law and Dispute Resolution
